What To Do If a Loved One Died Due to Someone’s Negligence

What does the Law Consider a Wrongful Death?

In the state of Georgia, the subject matter of a wrongful death personal injury action involves a death which resulted from the negligence, carelessness, or even intentional action of another party. This action is generally filed by the relatives and persons left behind by the victim as a means to recover damages from the person who caused the wrongful death.

Incidents that may result in a wrongful death can include automobile accidents, airline crashes, medical malpractice, defective products or deaths from over the counter drugs, or even from intentional acts such as homicide or murder.

You can file a wrongful death action even if the cause of death was due to a work-related injury. In fact, a high percentage of wrongful death cases occur at work. Some accidents in the work place can include slip and falls, equipment malfunction, explosions, or any other accident or incident resulting in the death of the employee. High risk industries include building and construction, industrial sites, plants, and manufacturing work places.

No matter what cause of the death, however, wrongful deaths result in unfortunate situations where survivors and family members are left devastated with the grief of losing a loved one while struggling to pick up the pieces of their regular lives and trying to deal with the sudden loss the deceased person’s income contribution. Family members who have the standing to make a wrongful death claim are generally grieving spouses, children, and/or parents of the deceased.
