Sample Contingency Fee Agreement for Injury Case

                  AGREEMENT WITH ATTORNEYS FOR CONTINGENT FEE

Client, [NAME OF CLIENT], employs and retains [NAME OF ATTORNEY OR LAW FIRM] as attorneys of record to represent the client for any claims she may have against the parties responsible for [NAME OF CLIENT’s] personal injuries, which occurred on or about [DATE OF INJURY].

In consideration of the advice, counsel and professional services of [NAME OF ATTORNEY OR LAW FIRM], in connection with the claim, client agrees to pay an amount equal to:

          (1)  33_ percent of any offer or settlement before suit is filed.

          (2)  40 percent of any offer, settlement, verdict or judgment after suit is filed.

          (3) Client agrees that all necessary costs and expenses advanced by the attorneys are to be paid by the client out of his/her share of the recovery.

          (4) Client agrees that all attorneys fees are to be computed on the total amount recovered before deduction for costs of litigation, medical expenses, and amounts paid to satisfy liens.

I understand that I may dismiss my attorneys at any time, for any reason, upon written notice to them and payment of unpaid expenses and services rendered to the date of the receipt of such notice; payment to be based upon time devoted to the case at an hourly rate of $225.00 per hour, or the applicable percentage of fee due them under the terms of this agreement of any offer, settlement, verdict or judgement made by or entered against an adversary or collateral party, whichever is greater. 

Client authorizes [NAME OF ATTORNEY OR LAW FIRM] to effect full settlement by compromise, suit, or otherwise, as they may deem best, with full power to associate other counsel.

The attorneys may withdraw at any time from the case, provided the client is given reasonable opportunity to secure substitute counsel.

In the event an appeal is necessary or appropriate, then a new and separate agreement shall be entered by the parties hereto as to services and fees.

I have read and understand the above agreement, and I approve all the terms contained therein.
